Accused Sharad Kalaskar granted bail in Dr Narendra Dabholkar murder case

Mumbai, 29 April – The Bombay High Court has granted bail to Sharad Kalaskar, an accused in the murder case of Narendra Dabholkar. The decision was delivered on 29 April by a Bench comprising Justice A S Gadkari and Justice Ranjitsingh Bhosale, with Justice Bhosale attending the proceedings online.

Sharad Kalaskar was arrested in August 2018 by the Maharashtra Anti-Terrorism Squad. Senior Advocate Nitin Pradhan, Advocate Shubhada Khot and Advocate Virendra Ichalkaranjikar represented him. Other advocates representing the accused in the case include Siddhavidya, Ghanshyam Upadhyay, Subhash Jha, Suvarna Awhad-Vats and Sachin Kanse.

Sharad Kalaskar is accused of firing the shots that killed Narendra Dabholkar. On 10 May 2024, a special court in Pune acquitted Virendra Tawde, Advocate Sanjeev Punalekar and Vikram Bhave in the same case. However, Sharad Kalaskar and Sachin Andure were sentenced to life imprisonment.

“I am satisfied that the Bench of the honourable Gadkari and Bhosale handled this case appropriately. A grave injustice had been done, as they were kept in custody for 10 to 12 years, and relief has now been granted to them. In my view, the investigation agency was not allowed to conduct a proper investigation. The relatives of Dabholkar, as well as their advocate, were responsible for this. They interfered at every stage of the investigation and exerted significant pressure through political and other means. As a result, the entire investigation was derailed.

The consequence of all this confusion ultimately affected the accused. They were arrested without any valid reason or connection to the case. They had to remain in prison for 8 years, and it appears that no one expressed any regret about this, because an image was created in society that a very serious murder had taken place and that they were responsible for it. This was the worst aspect. From a legal standpoint, the serious issue is that until an accused is proven guilty in accordance with the law, they are considered innocent. Here, the opposite happened — society assumed that since they were arrested, they must be guilty. The manner in which they were subjected to mental and physical harassment is a matter that society, the political system, and the judicial system must reflect upon.”

Advocate Virendra Ichalkaranjikar stated that the bail was granted by the High Court based on the same arguments that had earlier been presented before the Sessions Court, which had not taken them into consideration at that time.
