
New Delhi – While hearing a petition, a Bench of the Supreme Court headed by Chief Justice Surya Kant observed that the Supreme Court often issues sweeping orders while sitting in high positions without paying attention to the social realities of the country, and the adverse impact of such orders on the social structure is not taken into consideration.
The hearing was held on several petitions challenging the validity of provisions related to sedition in the Bharatiya Nyaya Sanhita and the permission given to the police under the Bharatiya Nagarik Suraksha Sanhita to conduct a preliminary inquiry before registering a criminal case.
The Chief Justice stated that courts are often misused. People who create controversies take advantage of them. Decisions are delivered in the name of alleged rights without understanding the conditions in society, the realities of rural areas and the lives of the people, and this leads to disruption of the country’s social structure. He added that to examine the validity of provisions in any new law, it is necessary to observe its implementation for a few years. If flaws are then found, it can be challenged.
