Prove citizenship within Ten Days; Else Face Deportation : Historical Decision of Assam Government

CM informed of deporting 30,000 Bangladeshi intruders

Guwahati (Assam) – A person, suspected to be an infiltrator, nabbed in Assam will have to prove his/her citizenship within ten days; failing which, the person will be deported to Bangladesh. This historic decision has been taken by Chief Minister Himanta Biswa Sarma. CM gave this information after the cabinet meeting held on 09.09.2025. He stated that the Government has sent back 30,128 infiltrators to Bangladesh. A new standard operating procedure has been approved for handling matters related to nabbing suspected infiltrators.

Operation Pushback is already going on

The Government has been working on extraditing infiltrators from the State in every way, including the ‘Operation Pushback’. The purpose of such an operation is to preserve the cultural identity of Assam and maintain its demographic balance. Under the Immigrants Expulsion from Assam Act, 1950, new yardsticks have been set which will enable the local administration to take direct action.

What is this strict procedure?

1. CM Sarma said that there is no need to go to court in every incident. The District Commissioner can directly verify the identity of infiltrators and issue orders for deportation.

2. A person suspected to be an infiltrator will be given ten days to prove his/her identity, and in case of failure, the district administration can order extradition within 24 hours. Then, such a person will be sent to a detention centre or expelled with the help of the Border Security Force.

3. This procedure will now be followed directly at the administration level, disregarding foreign tribunals.

4. Information on infiltrators will be collected under information technology, which will be used as the base for deciding security measures and implementation in future.

Decision taken based on an order passed by the Supreme Court – CM

CM stated that there have been more than 82,000 cases pending with the tribunals. The procedure was implemented based on a decision made by the Supreme Court bench in October 2024. The Court had stated that the Assam Government has full freedom to use the 1950 Law. This decision can be considered a decisive step in addressing the infiltration problem that Assam has faced for many decades.

Editorial Perspective

BJP-led States need to take such bold decisions and legally try a war footing for the deportation of infiltrators.
