Supreme Court rejects a Muslim’s plea to remove Bareilly Court’s observations related to the term ‘Love Jihad’

New Delhi – A case of Love Jihad had come to light in Bareilly, Uttar Pradesh. While giving its verdict, the local Bareilly Sessions Court, sentenced the culprit and said that the issue of religious conversion through Love Jihad cannot be ignored. Illegal conversions is a big threat to the unity, integrity and sovereignty of the country. A person named Anas had sought to remove the records of these observations made by the Bareilly Court through a PIL in the Supreme Court. During the hearing of the PIL, a bench of Justice Hrishikesh Rai and Justice S.V.N. Bhati asked the petitioner how the Supreme Court can remove the observations made by the Bareilly Court which were based on evidence. The Court dismissed the petition. The fast-track Court of the Additional Sessions Judge of Bareilly had recorded the above observations in its decision taken in this case on 30th September 2024.

The Court observed that Aleem had falsely pretended to be a Hindu to have sexual relations with the victim. The judge noted that he used deception to coerce the victim into having sexual relations and then pressured her to convert to Islam.

Important observations by Bareilly Court regarding Love Jihad

1. The Bareilly Court in its judgment clearly referred to the relevant case as an example of ‘Love Jihad’.

2. Aleem’s exploitation of the victim was part of a larger and disturbing pattern. This was not just a matter of individual deception, but a well-planned conspiracy to manipulate and sexually exploit vulnerable individuals in the name of religion.

3. The Bareilly Court compared the incident of ‘Love Jihad’ with the situation in Pakistan and Bangladesh, both of which are countries where cases of forced conversion are taking place on a large scale.

4. There is a need to curb incidents like Love Jihad; otherwise, the secular fabric of Indian society may deteriorate.

5. By allowing practices like ‘Love Jihad’ to continue unchecked, we risk creating a situation in India similar to that of Pakistan and Bangladesh.

6. Religious freedom is minimal in both countries, and women are systematically targeted for conversion.

What is the matter ?

This case comes under the jurisdiction of Deorania Police station of ​​Bareilly. A complaint was filed by a female student who was staying at an institute in Rajendranagar in the city for computer training. The accused Aleem, hiding his religious identity, called himself ‘Anand’ and lured the student into a romantic relationship. He took her to a temple, put vermilion on her forehead and had physical relations with her several times, saying that they were married. Later, she became pregnant. Over time, she came to know his real identity. Then he pressured her to convert to Islam. He also threatened to circulate her obscene photographs and videos. When the case went to the Court, the Court convicted Aleem and sentenced him to life imprisonment and 10 years in prison. Along with this, his father was convicted of threatening the victim and
sentenced him to 2 years in prison.
