
Kuala Lumpur (Malaysia) – Malaysia’s Federal Court has cancelled 16 Sharia laws passed by the State of Kelantan, declaring them unconstitutional. ‘These laws would have affected similar Sharia laws applicable in other parts of the country’, the Court said.
1.Crimes such as adultery, gambling, sexual harassment and desecration of religious places were covered under civil law while the State of Kelantan subsumed them under Sharia law. Therefore, a bench of 9 judges ruled 8 Vs 1 and cancelled these laws.
2.Chief Justice Tengku Maimun Tuan Mat said that the northeastern State of the country (Kelantan) had no power to legislate; because only Parliament has the right to make laws on these subjects. This matter has nothing to do with the situation of Islam in the country. The Kelantan Legislative Assembly has acted beyond its powers. Civil Courts do not support Islam or Sharia Courts.

Kelantan Government official Mohammad Fazli Hassan expressed disappointment at the decision and said, “Our Government will consult the royal ruler Sultan Mohammad V. 9 of Malaysia’s 13 States are headed by the king. He protects Islam.”
