Supreme Court rejects the review petition !

New Delhi – The Supreme Court has dismissed a review petition seeking a Central Bureau of Investigation (CBI) or National Investigation Agency (NIA) probe into the genocide of Hindus in the Kashmir Valley in the 1990s. The review petition was filed by a non-governmental organisation ‘Roots in Kashmir’.

The Supreme Court on 24th July 2017 also rejected the petition making such a demand. The Court rejected the plea saying that it is difficult to collect evidence of genocide after so many years. A petition was filed again in October 2022 to reconsider this verdict.

1. The Court had said at the time that what had happened to the Kashmiri Hindus was shocking, but after 27 years there is no use of filing a petition in this regard. Thus, an enquiry cannot be ordered.

2. The petition further stated that between 1989 and 1998, more than 700 Kashmiri Hindus were killed. In more than 200 of these cases, crimes were registered; however, no charge sheet was filed in any of the cases.

Petitioners drew the Court’s attention to the fact that the anti-Sikh riots in Delhi are being investigated freshly !

While filing this review petition, ‘Roots in Kashmir’ had said that it is not appropriate to dismiss the petition on the ground of delay. Anti-Sikh riots in Delhi are being re-investigated. Time limits do not apply to investigations into incidents such as crimes against humanity and genocide.
