Gyanvapi Mosque case : The next hearing will be today  

 Varanasi (UP) – During the hearing on Gynanvapi Mosque on 24th May, the Court said that the case will be heard on 26th May. Also, the Court directed both parties to file objections to the survey report within a week. Both parties are also ordered to provide video recordings and photographs of the survey.

1. The first hearing of the case will take place on 26th May. The Muslim petitioners have raised objections to the course of action of the lawsuit. According to them, the lawsuit was filed in violation of the Places of Worship Act, 1991. Therefore, it should be abolished, but the Hindu petitioners say that they have filed a petition seeking permission to regularly worship Shri Sringargauri Devi, which is at the site of Gyanvapi Masjid. It does not constitute a violation of this Act.

2. During the hearing held on 24th May, Muslim petitioners asked, can there be a trial under Order 7 Rule 11 or not ? & demanded a decision on this. The Hindu petitioner was of the view that the objection to the survey conducted in the Gyanvapi area should be heard first. The Court then said that the first hearing on the course of the action to be taken on the case would be held on 26th May.

What is Order 7, Rule 11  ?

As per Order 7 Rule 11, it is examined whether it is more appropriate to hear the petition than to consider the merits of the facts on the petition filed in the Court ? If relief is sought from the petitioner, then whether it can be granted by the Court or not ? If the Court finds that it cannot, then Court may, without considering the merits of the case, dismiss the petitioner without hearing it. Under Order 7, the Court may dismiss the petition at the outset for various reasons. If the petitioners do not state the reasons for filing the petition or the claims in the petition do not contain facts, the Court may restrain them before filing the petition.
