The Court observed granting protection to them would indirectly mean giving assent to illicit relation
Prayagraj (UP) – Allahabad HC rejected the plea of a married woman living in a live-in relationship with a man other than her husband. The Court dismissed the protection plea of the married woman and her live-in partner with an exemplary charge of Rs.5,000. However, the Court made it clear that it was not against the live-in relationship but was against illicit relations.

1. The Court stated that according to the Hindu Marriage Act, no law-abiding married person, can seek protection in the Court for illicit relations; as illicit relations do not come under the social dignity of this country. If protection was granted by the Court, it would be tantamount to approving an illicit relationship.
2. According to the woman petitioner, she left her husband because he tortured her, and began to live with her lover, but her husband barged into her lover’s house and foiled her peaceful life.
3. The Court stated that if the woman’s husband barged into her partner’s house, it would be a criminal case. Therefore, the woman could file a complaint with the Police. The Court also advised the woman to take up the legal procedure for divorce.
