#Boycott_Amazon: Hindu Janajagruti Samiti (HJS) issues legal notice to Amazon India!

  • The case concerning the denigration of India's great mathematician Aryabhata

  • Demands to tender apology and retract controversial advertisement within 48 hours

  • Declares that the disrespect of national heritage for commercial gains will not be tolerated

Mumbai/New Delhi – Advocate Amita Sachdeva of Hindu Janajagruti Samiti, practising in the Supreme Court, has sent a legal notice to Amazon India for portraying ancient India’s great mathematician and astronomer ‘Aryabhata’ in a highly derogatory manner in a commercial advertisement. She has demanded that Amazon India tender an apology to Indians and withdraw the controversial advertisement immediately within 48 hours. The notice also warned that if this demand is not met, a criminal and civil case will be filed against Amazon.

Amita Sachdeva said,

1. The advertisement depicts a man dressed as Aryabhata and shows him in a sarcastic and mocking manner as a ‘scientist searching for the relevance or presence of “zero” in modern India’.

2. To reduce a great sage-like scientist, who gave the invaluable concept of ‘zero’ to the world and brought global recognition to India’s scientific achievements, to a comic commercial character solely for commercial gain is a deliberate insult to India’s great intellectual heritage and national identity.

3. This is not the first time that Amazon has insulted Indian culture and Hindu symbols for commercial gains. In the past too, the company has had to apologize for selling doormats and toilet seats bearing pictures of Shri Ganesh and Mata Lakshmi and for hurting religious sentiments through the web series ‘Tandav’. That time after strong protests the company had to tender an apology.

4. Any act of deliberately insulting Indian national personalities for commercial gain is liable for direct criminal and civil action under Sections 299 (outraging religious feelings), section 196 and 197 (promoting enmity and harming national integration) and 302 (intent related to hurting religious sentiments) of the Revised Indian Judicial Code – Bharatiya Nyaya Sanhita (BNS).

5. The notice also firmly demands permanent removal of the controversial advertisement from YouTube, Instagram, X, etc., tendering public and unconditional apology by the establishment on its official social media accounts, on the home page of its website and in leading newspapers of the country and giving an undertaking in writing that national symbols and national figures will not be disrespected in the future.
