Telangana High Court’s observations while admitting the woman’s petition for divorce

Bhagyanagar (Telangana) – The Telangana High Court made an important observation in a divorce case in the state. The Court observed that the wife had consented to the marriage under the mistaken belief that there was compatibility in age and horoscope matching, as the husband had provided an incorrect birth date. This is cheating. The Court accepted the woman’s petition for a divorce. The woman had claimed that the horoscope matching was incorrect because the husband had provided a false birth date.
1. A Division Bench of Justice K. Lakshman and Justice B.R. Madhusudhan Rao set aside the Family Court’s order that had dismissed the wife’s petition under Section 12(1)(c) of the Hindu Marriage Act, 1955.
2. This couple got married in 2018. The husband’s actual date of birth was 9 February 1974, but he lied that it was 9 February 1981. She said that she came to know this fact later.
3. While granting the divorce, the High Court noted that issues such as permanent alimony, return of gold jewellery and settlement between the parties would be dealt with before the appropriate forums. This would also include the pending domestic violence case filed by the wife against her husband.
