Thiruvananthapuram (Kerala) – The Kerala High Court has quashed the State Government’s order granting 80% of minority scholarships for Muslim students and 20% to Latin Catholics and converted Christians. The court said that the order of the State Government cannot be legally sustained. Therefore, the Government should provide reservations based on equality to all notified minorities.
- The Court held that the State Government giving reservations to weaker sections is not wrong; but when it comes to notified minorities, they should be treated equally. The Government has no right to discriminate against minorities. In this case, the Christians of the State are being given 20% reservation, ignoring their right to get a reservation based on equality. It is unconstitutional and no law will support it.
- Advocate Justin Pallivathukal, while filing a petition against the Government’s order alleged that the State Government was giving more priority to Muslims, in the State Government’s policy providing scholarships to the students of the minority community, pursuing undergraduate and postgraduate studies.
