Grave Situation of Disposal of Court Cases in Maharashtra

Demand for Fast-track courts for hearing of cases like murders, rapes, etc., more than 1.5 lakh cases pending

Mumbai – Serious crimes related to sexual exploitation of children, young girls and women have considerably increased in the last year. People take to the streets to demand early disposal of cases in fast-track courts and punishment to the offenders involved in inhuman, barbaric oppression. The fact, however, is that even in the fast-track courts, the cases have been pending for many years. The number of cases, civil and criminal,  pending in fast-track courts in Maharashtra is 1, 61, 937 as obtained in August 2025. Presently, there could be a slight increase or decrease in the number.

Under the Right to Information Act (RTI), Mr Pritam Nachankar, a special correspondent of ‘Sanatan Prabhat’ periodicals, had asked the Mumbai High Court for information on the situation of pending cases in the fast-track courts. The Mumbai High Court has officially given the above information. As per the information received from the Mumbai High Court, 81 fast-track courts under the 11th Finance Commission and 14 fast-track courts under the 14th Finance Commission, i.e., a total of 102 fast-track courts, are in operation in Maharashtra. The duration of these courts is till March 2027. (After the end of the period, the State Government grants extension to these courts through the Law and Justice Department and makes financial provision.)

Cases pending for 8-10 years

Among the pending cases, criminal cases are 59,887, which include cases related to the sexual exploitation of girl-children and women. The exact number of pending cases is not available; however, considering the total pending cases, the number of cases of exploitation of children and women must be in the thousands. The serious thing about these cases is that some are pending for 8-10 years due to an inadequate number of judges, absence of witnesses, and delay by investigating agencies in investigations and in filing charge sheets, etc. It is a very serious matter, and the Government should find a proper solution to the problem.
