Important observation by Allahabad High Court
Action under the National Security Act upheld

New Delhi – The Allahabad High Court, while hearing a petition, observed that cow slaughter is an issue that “has an inherent potentiality of creating widespread ripples in society that would affect the even tempo of life.” The Court noted that such acts are not ordinary crimes but have the capacity to trigger strong social and communal reactions.
The observation came in connection with an incident on 15 March 2025, during Holi, when cattle remains were found in a field in Shamli district of Uttar Pradesh, leading to tension in the area. The police had arrested certain accused and invoked the National Security Act (NSA) against them. One of the accused challenged this action before the High Court, arguing that the matter pertained only to law and order and did not warrant action under the NSA. The Court rejected this contention.
A Division Bench comprising Justice J J Munir and Justice Sanjiv Kumar stated, “There are some issues, where the community is sensitive to the extent that if these surface, there is an inherent potentiality of creating widespread ripples in society… One of them is cow slaughter.”

Incident affecting public order
The Court further observed, “The slaughtering of a cow, whenever reported or detected, spontaneously evokes strong emotions and violent reactions for obvious injury to religious beliefs of a large section of the society.” It added that such incidents have historically led to emotional upsurge and violence, and therefore cannot be treated as routine offences.
The Bench emphasised that such acts go beyond ordinary criminal offences and impact public order. It held that invoking the National Security Act in such circumstances was justified, as the act had the potential to disturb public peace and social harmony.
Legal and social implications
The Court also noted that the offence in question was not limited to harm against an individual but had wider implications on the community, as it “aroused public outrage amongst a large section of the population… whose religious feelings were hurt.”
The observations underline that while maintaining law and order, the administration must also consider the broader impact on public order. The Court’s ruling reinforces the position that actions affecting societal harmony may warrant stringent legal measures such as those under the National Security Act.
