Allahabad High Court refuses to absolve the accused of the crime registered against him

Prayagraj (Uttar Pradesh) – The Allahabad High Court has clearly refused to absolve the accused of the crime registered against him. The case pertains to a statement claiming that Muslims are being targeted in BJP-ruled states and that the Constitution is being trampled upon. The Court made the significant observation that such statements can spread communal hatred in society and may disrupt public peace.

These remarks were made by the bench of Justice Prashant Kumar during the hearing of the case.

1.The right to freedom of speech and expression granted by the Constitution is not unlimited. No one has the freedom to make statements that endanger law and order or disturb social harmony.

2.Making statements that create fear or hatred against a particular community can prima facie amount to a criminal offence.

3.The matter is currently under investigation, and prima facie, an offence appears to have been committed. Therefore, there is no reason to interfere with the legal proceedings ongoing in the lower court.
