Police issue notice to Adv. Rohan Malvadakar asking not to stay at his home near Koregaon-Bhima ‘Jaystambh’ on 1st January

Notice issued by Lonikand Police

Battle of Koregaon-Bhima

Pune – Advocate Rohan Malvadkar Jamadar is the 7th direct descendant of Khandoji Jamadar (Malvadkar), the leader of the Koregaon-Bhima battle. He has presented true history with evidence through his book titled ‘Reality of Koregaon-Bhima Battle’. The ‘Jaystambh’ stands in his farmland, and his house is next to it. The Lonikand Police have advised him to avoid staying at his house on January 1st through a notice. The notice also states that he should not spread any message on social media that may cause a rift between the two communities. (Has the Police administration issued such notices to those circulating misleading and divisive videos and messages about the ‘Koregaon-Bhima Battle’ on social media ? Do they expect Advocate Malvadkar to stay at the Police station instead of staying in his own house ? The Police are denying Advocate Malvadkar the freedom granted by the Constitution due to their own inefficiency and cowardice – Editor).

Reply given by Advocate Rohan Malvadkar to the notice

1. This notice is an attack on the fundamental rights guaranteed by the Constitution

The notice is in direct violation of the Bombay High Court’s orders. ‘We have our own house next to Jaystambh and the administration has no right to decide when we should and should not visit there. Giving us directions on when to visit our residence is tantamount to attacking the fundamental rights granted to citizens by the Constitution.’

2. The right to tell the true history of Jaystambh

I have not, to date, disseminated any objectionable, provocative or socially divisive views on social media about Jayastambh or the Koregaon-Bhima battle, and I will not do so in the future; however, I have the right to present true history based on Government documents, records and solid evidence, which I have exercised to date and will continue to exercise.

3. Action should be taken against those who spread wrong history

If this notice means that ‘presenting true history’ means creating a rift between two communities, then the Police should first take action against those spreading wrong, distorted and false history. I am only trying to stop the misguiding of society by telling the truth and presenting the real history to society based on Government evidence. I have no other intention behind this and never had.

4. The Government should take initiative to tell the true history

I will stand firmly on my views. I do not need anyone’s permission to tell the true history, because the Constitution has given me that right. If someone’s feelings are hurt because I tell the true history, then they need to study history on the basis of contemporary documents, and the Government should take the initiative to tell the truth in this. The administration itself needs to take the effort to tell the true history.

Battle of Koregaon-Bhima and riots

The battle of Koregaon-Bhima was not against any caste or religion, but the Maratha army against the British, and this battle was sudden. In the battle of Koregaon, 834 British soldiers fought against a contingent of 3,000 Arabs and Gosavi soldiers on the side of the Marathas. There were 3 battalions of these 834 soldiers. The first battalion had 500 infantry including Brahmins, Marathas, Gurjars, Sikhs, Muslims, Ahirs and Mahars. The second battalion had 250 cavalry, and the third battalion had only Europeans. This was the military system; but now some people are saying that this battle was ‘28,000 Peshwas against 500 Mahars’. The purpose behind this is to separate the ‘Mahar’ community from the Hindus. The British erected a victory pillar here in memory of this battle.

On January 1st, 2018, the State Government had organized programmes to mark the 200th anniversary of this battle; however, the previous day, inflammatory speeches by speakers at the ‘Elgar Parishad’ of pseudo liberal organizations in Pune had created tension in the area of Jaystambh and riots broke out. A young man named Rahul Phatangade died in this. The investigation into this riot is still ongoing.

Editorial Perspectives

  • For the first time in the history of independent India, the Police have issued a notice to the owners of the land where the Jaystambh stands, and to those who are responsible for its maintenance, not to stay in their home.
  • The public feels that the Police, who are supposed to protect the fundamental freedoms of citizens along with maintaining law and order, are displaying their own cowardice by issuing notices asking citizens to flee.
