Why shouldn’t firecrackers be banned across the country ? : Supreme Court

New Delhi – The Supreme Court on September 12 raised the question of why the year-round ban on firecrackers in Delhi-NCR (National Capital Region) should not be implemented across the country. A bench of Chief Justice B.R. Gavai and Justice K. Vinod Chandran recorded oral observations in this regard.

The court clarified that the right to pollution-free air cannot be limited to the citizens of the capital alone. If the citizens of Delhi have the right to clean air, so why not for citizens of other states? While hearing the petition of firecracker traders, the court said that there must be a unified policy across the country.

Ban will affect 5 lakh families – Senior Advocate K. Parameshwar

Regarding this, Senior Advocate K. Parameshwar said that it may be appropriate to ban firecrackers from October to February; but the year-round ban will affect an estimated 5 lakh households that manufacture and sell crackers. Cracker manufacturers are collaborating with the National Environmental Engineering Research Institute (NEERI) to produce permissible crackers; yet their licenses are being revoked. After this, Additional Solicitor General Aishwarya Bhati said that NEERI is analysing the issue related to firecrackers and has sought advice from the scientific fraternity.

On this, the court asked for a report from the Additional Solicitor General on the ‘Air Quality Management Commission’ and directed that the status of the existing licenses be maintained as is.
