Supreme Court commends Mumbai High Court’s order while reprimanding petitioners

Mumbai – Seventeen buildings at Mumbra falling under Thane Municipal Corporation have been built illegally by builders with links to the underworld; therefore, the Supreme Court has refused to interfere in the order issued by Mumbai High Court about their demolition. Besides, the Supreme Court has praised Mumbai High Court for its brave stand about issuing the order of demolition of such buildings. The Supreme Court has also reprimanded the petitioners for daring to file a petition directly in the Supreme Court when they are trying to save their illegal buildings in the name of the innocent flat owners.

Justice Manmohan stated while passing the order that the petitioners should think of their city since such things would encourage encroachment everywhere. Mumbai High Court has taken a very courageous step and we appreciate the Court for its right decision.

The Supreme Court stated –

1. It is shocking that a few people thought of coming to the Supreme Court. The situation is grave. There are certain rules and regulations regarding illegal constructions. Is Thane Municipal Corporation really aware of what is happening within its jurisdiction ? Mumbai High Court has tried to be vigilant and to establish law.

2. Those buildings have been built without obtaining required permissions. The attitude of dishonest builders will not change till action is taken against them. People will try to shoot from your shoulders. This should be stopped.

3. Justice Bhuyan stated that had an innocent woman not come to court and appealed that there was an encroachment on her land, the issue of illegal construction would not have been exposed. This aged woman would not have been able to fight singly with the land- mafias and against such large-scale illegal constructions.

Editorial Perspective

The Government should sentence the concerned administrative officers to life imprisonment, who granted permission for such buildings and overlooked the issue till the construction was complete.
