Allahabad High Court refuses to quash the prima facie report against the accused

An issue about posting a hate speech against Chief Minister Yogi Adityanath and Dhirendra Shastri !

Prayag (Uttar Pradesh) – The Allahabad High Court has refused to quash a First Information Report (FIR) registered against a person who posted hate speech on Facebook against the Uttar Pradesh Chief Minister Yogi Adityanath and spiritual leader Dhirendrakrishna Shastri. The petitioner, a man named Deepak, a member of the Bhim Army, had moved the High Court seeking to quash the case registered under Section 505(2) (public misconduct) of the Indian Penal Code.

Another person called Vijay Kumar Gautam had alleged in his complaint against the petitioner Deepak, that the accused had used abusive language against Chief Minister Yogi Adityanath and Shastri on Facebook. The High Court however while dismissing the petition said, ‘From the perusal of the prima facie report, it cannot be said that no cognizable offence has been committed. Therefore, no prima facie reason exists for setting aside the report or staying the arrest of the petitioner.’
