New Delhi – In the 2000, Delhi Red Fort attack case, the Supreme Court rejected the review petition of ​​Lashkar-e-Toiba terrorist Mohammad Arif alias Ashfaq and upheld the earlier death sentence. Chief Justice Uday Lalit and Justice Bela M. Trivedi’s bench upheld this sentence. On 22 December 2000, 3 soldiers were martyred in the indiscriminate firing by Arif at the Red Fort.

Arif is a native of Abbottabad, Pakistan. He had fired indiscriminately at the 7th Battalion of Rajputana Rifles at the Red Fort.

While passing the order in this matter, Chief Justice Uday Lalit said, ‘We have accepted the plea of ​​the petitioner about not considering the electronic records, but looking at this case in its entirety proves his crime. We uphold the earlier order of the Court and dismiss the petitioner’s review petition’.

Timeline of 22 years of events to affirm the death penalty !

  • Arif was arrested on 25th December 2000.
  • On 24th October 2005, the Sessions Court convicted him and sentenced him to death on 31st October 2005.
  • Arif then challenged the Sessions Court decision in the Delhi High Court. The Delhi High Court on 13th September 2007 upheld his death sentence.
  • Arif appealed to the Supreme Court. On 10th August 2011, the Supreme Court also upheld his death sentence.
  • Following this, Arif’s petition for reconsideration of the death sentence was dismissed by the Supreme Court on 28th August 2011.
  • Then, in the year 2014, the Supreme Court stayed the punishment proceedings.
  • In 2016, the Supreme Court once again decided to hear the review petition. At that time the order stated that the review petitions in death penalty cases should be heard in open court.
  • Finally, on 3rd November 2022, the Supreme Court once again sealed Arif’s execution.
