In Assam, illegals can be deported from India without trial

1950 law is implemented only in Assam

Himanta Biswa Sarma, the Chief Minister of Assam

New Delhi – Assam will use the 75-year-old law to deport the Bangladeshi illegals. According to this law there is no need to take the permission from the Court. Supreme Court has permitted Assam Government to use this law, informed the State Chief Minister, Himant Biswa Sarma.

Assam Government can use the 1950 law of ‘Migrant evacuation order’. This law empowers the district magistrate to deport the illegals, stated Sarma.

This law is applicable only in Assam. If the Union government feels that a person who is from outside Assam and is dangerous for the security of common people, the government can deport him. Though the Union government has the power; the power can be delegated to Assam government officials.

Editorial Perspective

Amendment and implementation of the 75-year-old law is needed across the country. All the nationalist advocates should pressurise the government for this.
