Rape offence should not be registered in cases where love relationship goes sour : Supreme Court

New Delhi – Offences like rape are being registered in a relationship that does not reach marriage. It is wrong. Being in a relationship has become a crime. If you break up with someone, it does not mean that there has been a rape. Rape offence should not be registered in cases in the event of breaking up of a love relationship and then staying separately afterwards- the Supreme Court opined on the rape case. A man has filed a petition in the court seeking quashing of the rape case against him. In it, he has been accused by a woman of forcing her to have sex on the pretext of marriage.

The court further said that since the victim has appointed a senior advocate, she cannot be considered innocent. Since you are an adult, you cannot say that ‘you were cheated, trust was gained by with the promise of a marriage’ and just because the romance dwindled or ‘break up’ happened does not mean that rape has been committed. The way society is changing, we need to understand that breaking up of relationships should not become a crime of rape. Today, morality and values have changed. Especially the younger generation is changing. If we accept this, the relationship between boys and girls in colleges will be punishable. Suppose two college students are in love and if the boy said, ‘I will marry you’, after which he did not do anything. So will that be considered a crime too ?
