The statement also claims MISA Law snatched away the rights of people
Mumbai – ‘Congress imposed an Emergency on those who raised slogans of ‘Save the Constitution’, stripping Indians of their fundamental rights and freedom of expression. A system was established where governance was not based on law but decrees. More than 1,00,000 opposition leaders were imprisoned. My father was in jail for two years. My aunt, Shobha Fadnavis, was also imprisoned. At that time, no one was able to explain what their crime was. Congress abused Dr Babasaheb Ambedkar’s Constitution and sent the entire opposition to jail’, Chief Minister Devendra Fadnavis said on 26th March in the Legislative Assembly. He was responding to a discussion on ‘The Glorious 75-year Journey of the Indian Constitution’.

The Chief Minister further said,
1. In 1971, Congress introduced the Maintenance of Internal Security Act (MISA), which snatched away the fundamental rights of common citizens. Now, slogans of ‘Save the Constitution’ are being raised, but during the Emergency, fundamental rights were suspended by law, and freedom of expression was taken away.
2. Renowned singer Kishore Kumar was banned from All India Radio for saying that the Emergency was not justified.
3. Congress made 99 amendments to the Indian Constitution. The most significant amendment ensured that the Prime Minister and the Speaker of the Lok Sabha would not fall under judicial scrutiny. As a result, the Supreme Court’s verdict against former Prime Minister Indira Gandhi was overturned.
4. The 42nd Constitutional Amendment transferred powers from states to the Union Government. Following this, the President became merely a puppet, compelled to sign decisions sent to them. Congress was responsible for this amendment.
5. An amendment was introduced allowing Central Police and investigative agencies to intervene in any state. However, today, they cannot do so without the state government’s permission. The President and the Governor were given the authority to nullify decisions.
6. The current opposition is failing to come to power, so they are discrediting the country’s institutions. Tarnishing institutions, questioning them, and pushing them towards anarchy is ongoing. However, when we discredit these institutions, we show distrust in the Constitution, as these institutions were created by it. They are so strong that no one can break them.
The words ‘Socialist’ and ‘Secular’ were not in the original Constitution
When Bharat Ratna Dr Babasaheb Ambedkar drafted the Constitution, India was established as a Sovereign Democratic Republic. However, during the Emergency, Indira Gandhi added the words ‘Socialist and Secular’ to the Constitution. These words were not part of the original Constitution. Dr Ambedkar knew that the very essence of this nation was secular.
