Allahabad High Court seeks response from Union Govt and ASI in Tejo Mahalay case

Petition claims Taj Mahal is the Tejo Mahalay temple

Prayagraj (Uttar Pradesh) – The Allahabad High Court has directed the Union Government and the Archaeological Survey of India (ASI) to file their replies in a petition claiming that the Taj Mahal is the Tejo Mahalay temple. The direction was issued during the hearing held on 6 July.

The petition has been filed on behalf of Agreshwar Mahadev Nagnatheshwar Virajman by five petitioners, including senior advocate Pujya Hari Shankar Jain. It seeks a declaration that the Agreshwar Mahadev Nagnatheshwar Virajman Tejo Mahalay Temple exists within the Taj Mahal complex.

Petitioners seek the appointment of an Advocate Commissioner

Arguing before the Court, Pujya Hari Shankar Jain submitted that an application had earlier been filed before the trial court seeking permission to conduct videography and photography of the site and for the appointment of an Advocate Commissioner. However, the trial court rejected the application. A review petition was subsequently dismissed as not maintainable. He argued that a survey and documentation of the site are essential for the proper adjudication of the dispute.

The main case has been pending since 2015

The Court noted that the main civil suit relating to the Taj Mahal has been pending before the Agra Civil Court since 2015. The suit seeks a declaration that the Agreshwar Mahadev Nagnatheshwar Virajman Tejo Mahalay Temple exists within the Taj Mahal premises.

While that suit was pending, an application was filed seeking the appointment of an Advocate Commissioner. That application was rejected by both the trial court and the appellate district court.
