Upload court orders on the very same day

Mumbai – The Bombay High Court has directed that all orders passed must be uploaded on the ‘CIS server’ (Case Information System, a part of the e-Courts system) on the very same day. It has also warned that if any discrepancy is found between the original record and the uploaded version, the concerned judicial officer may be suspended without even a departmental inquiry. This warning has been issued through a circular dated 4 April.

The circular was issued following a Public Interest Litigation filed by the NGO ‘Dard Se Hamdard Tak’, through its trustee and advocate Prakash Salsingikar. The matter was heard on 6 April.

The hearing took place before a division bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Gautam Ankhad. During the hearing, directions were issued to send copies of the daily status report annexed to the petition to the concerned District and Principal Judges. The courts have been directed to submit, within one week, details such as the daily order sheet, the orders passed, and the date on which they were uploaded on the website. The next hearing in the matter is scheduled for 17 April.

Monthly review to be mandatory!

The circular clearly directs all judicial officers in Maharashtra and Goa to upload all court orders and judgments on the same day. If this is not done, recording the reasons and details for the delay will be mandatory. Failure to upload orders or judgments on time will be treated as misconduct affecting the integrity of the judicial officer. Judicial officers have also been instructed not to retain case records after disposal. Additionally, they must submit monthly reports on whether court decisions have been uploaded in a timely manner.

What is the case about?

The Supreme Court has already directed all courts to upload their orders and judgments on the CIS server under the e-Courts initiative. To ensure implementation of this system in the Bombay High Court, the NGO ‘Dard Se Hamdard Tak’ filed a petition in June 2025. The first hearing in the matter took place in September 2025, following which the present circular has now been issued in compliance with judicial directions.

 

“Judicial process will become transparent!” – Advocate Prakash Salsingikar 

Advocate Prakash Salsingikar stated that if court proceedings are uploaded on the same day under the e-Courts system, advocates and citizens will clearly know what transpired in a case. It will also ensure that what advocates argued is accurately reflected in the uploaded records.

This will bring transparency to the judicial process and enhance the credibility of the justice system, he said while speaking to a representative of ‘Sanatan Prabhat’.
