Bhopal (Madhya Pradesh) – The Gwalior bench of the Madhya Pradesh High Court has quashed the candidature of Congress MLA Mukesh Malhotra from Vijaypur assembly constituency for concealing information about criminal cases against him in his election affidavit. In this case, the court ordered the declaration of BJP candidate Ramniwas Rawat, who garnered second highest votes in the by-election after Malhotra, as the new MLA of Vijaypur.

In the by-elections held in 2024, Congress MLA Malhotra did not give complete information about the criminal cases against him in his nomination form and affidavit. Rawat filed a petition in the court stating that a total of 6 criminal cases have been registered against Malhotra; However, he mentioned only 4 cases in his affidavit and concealed information about other 2. On this, a bench of Justice GS Ahluwalia accepted Rawat’s contention and said that ‘concealing facts in an election affidavit is a violation of election law’ and quashes the candidature of  Malhotra as an MLA.

Rawat had won the 2023 Assembly elections on a Congress ticket and became an MLA. However, he joined the BJP before the 2024 Lok Sabha elections and was made a cabinet minister directly in Chief Minister Mohan Yadav’s BJP government. Then a by-election was held in the Vijaypur constituency.

Will challenge High Court’s decision in Supreme Court

Malhotra’s advocate Pratip Bisoria informed that he will challenge the high court’s decision in the Supreme Court.
