
Lucknow (Uttar Pradesh) – Providing Scheduled Caste benefits to individuals who have converted to Christianity amounts to a “fraud on the Constitution and is contrary to the ethos of reservation policies”, the Allahabad High Court has held. According to a reports, the court directed the Uttar Pradesh government to stop extending such benefits, warning that failure to do so would violate constitutional principles.

1. In an order dated 21 November 2025, Justice Praveen Kumar Giri cited Paragraph 3 of the Constitution (Scheduled Castes) Order, 1950, which specifies that only Hindus, Sikhs and Buddhists can be recognised as members of Scheduled Caste communities.
2. The court directed the principal secretary of the minorities welfare department to take appropriate steps to ensure strict separation between minority status and Scheduled Caste status. It noted that retaining SC benefits after conversion to Christianity amounted to fraud, as the Christian faith does not recognise caste.
All district magistrates have been given four months to act in accordance with the law to identify and prevent such instances.
Order for an in-depth inquiry into Sahani :
Justice Giri issued these directions while dismissing a plea filed by a man accused of “mocking Hindu deities” and promoting enmity. The petitioner, Jitendra Sahani, had sought quashing of the charges, arguing that he had applied for permission to “preach the words of Jesus Christ on my land”. The court observed that although Sahani had converted to Christianity, he had declared “Hindu” as his religion in his affidavit. It was also noted that he belonged to an SC community prior to his conversion.
A witness in the case alleged that Sahani disparaged Hinduism for caste hierarchies, claiming that converting to Christianity would bring “jobs, business growth and financial benefits from the missionaries”.
The court also referred to a recent Supreme Court judgment — C Selvarani vs Special Secretary-cum-District Collector (2024) — which held that a person ceases to belong to a caste after converting to Christianity.
