Action taken against a doctor in the emergency ward for not standing up when an MLA arrived

Chandigarh – During the Corona pandemic, the Haryana Government issued a show-cause notice to the doctor for not standing during the MLA’s arrival in an emergency ward. The Punjab and Haryana High Court imposed a fine of Rs 50,000 on the Haryana Government in this regard. It has also issued directions to issue the ‘No Objection Certificate’, to the doctor, as he could not pursue the postgraduate medical education.

The High Court said while giving the order that, expecting the doctor to stand during the MLA’s arrival in the emergency ward and proposing disciplinary action against him, was disturbing. The petitioner’s explanation regarding not recognising the MLA and that he did not do anything that would insult the MLA, was completely ignored. It was insensitive for the State to take action against the petitioner on such allegations. Only a ‘show cause’ notice is pending against him; therefore, depriving him of his rights to pursue higher medical education by withholding the ‘no objection certificate’ is akin to superiority.
