Supreme Court rebukes Union Government — orders issuance of death warrant before next hearing

New Delhi (24 September 2025) — In the case of the assassination of former Punjab Chief Minister Beant Singh, Babbar Khalsa militant Balwant Singh Rajoana was convicted and sentenced to death. Yet, neither the Union Government nor prison authorities have carried out the execution.

During a hearing, a three-judge bench of the Supreme Court (Justices Vikram Nath, Sandeep Mehta and N.V. Anjaria) sharply questioned the Centre: “Why did you not hang him till now? Who is to blame for that? At least we have not stayed the execution.”
The Court made it clear that it would not grant any interim stay on the execution, and insisted that the execution process should move forward before the next hearing. It also reproached the Centre for inaction: “Who is responsible for the delay? We did not stay the execution. You had to take a call.”
Additional Solicitor General K. M. Nataraj, appearing for the Union, sought more time to file a status report, citing the gravity of the crime.
Senior advocate Mukul Rohatgi, representing Rajoana, pointed out that no decision had been taken on the convict’s mercy petition, and questioned even the prisoner’s mental condition after decades on death row: “One does not know what is going on… If the death sentence has to go, commutation must happen. If commutation happens, he can come out.”
The bench scheduled the next hearing for 15 October 2025, and explicitly stated that further adjournments at the instance of the respondents would not be permitted.
