Delhi High Court decision: No criminal charges against those who sheltered foreign nationals of Tablighi Jamaat during Corona .

New Delhi – The Delhi High Court has given its ruling on cases filed against Indians who sheltered foreigners who attended the Tablighi Jamaat Headquarters’ camp here during the first wave of the Covid pandemic. The court ordered the quashing of 16 cases against 70 Indians. The court stated that the chargesheets filed in the case are being quashed in view of the current circumstances and the available evidence. It would not be in the interest of justice to continue the trial.

The original charges in the case

In this case, it was alleged that 70 Indians had sheltered around 190 foreign nationals in their homes. The foreign nationals had attended the event organized at the Tablighi Jamaat headquarters in Nizamuddin, Delhi in March 2020. The Delhi Police had registered cases against the accused under various sections of the Indian Penal Code such as Epidemic Diseases Act, Disaster Management Act and the Foreigners Act. The police said that the accused had violated the rules by keeping foreign nationals at home during the lockdown, ignoring government orders.

The lawyers for the accused argued that the accused had no criminal intent and that there was no concrete evidence that could convict them.
