A total of 5.25 crore cases are pending in all courts in India

  • One out of every 27 Indians is waiting for justice

New Delhi – More than 5.25 crore cases are pending across all levels of the Indian justice system, including the Supreme Court, High Court and subordinate Court. This means one in every 27 Indians is waiting for justice anxiously. Things are not simple enough to get justice in one court; the dispute is taken to the next level by the complainant and the plaintiff invariably. There is a proverb, ‘compromise is the best and cheapest lawyer’, indicating, avoid court at all costs. The truth of this proverb is seen in the enormous number of pending cases revealed by the Ministry of Law and Justice. Of the 5.25 pending case, 60,000 cases are in Supreme Court, 58 lakh are in various High Courts and the rest are in the Lower Courts across the country.

These shocking statistics indicate injustice, not justice.

1. Three cases have been pending in two High Courts of the country for 52 years. These include two cases in Calcutta High Court, and one in Madras High Court.

2. More than 62,000 cases in the High Court are 32 years old.

3. In the Lower Courts across the country pending cases are more than 30 years old.

4. In the Capital of India, New Delhi in the Rouse Avenue Court is heading towards verdict now, after 39 years. Justice S.K. Tyagi and his associates are the accused in this case and the trial had begun in 1984-85. Justice Deepak Kumar who is hearing the case now, was only two-year old at that time. Of the 13 accused, two are already dead. Now at the age of 41 years, Justice Deepak Kumar is busy hearing the case and to take it to the verdict.

5. In Delhi itself, a case filed in Tees Hazari Court in 1972, is still pending. While a case from 1956 is still pending in Rajasthan.
