Mumbai – The Police should register complaints regarding loudspeaker noise from mosques and issue a warning the first time. If the violation occurs again, the loudspeakers should be seized, according to an order of the Bombay High Court.
This important order was issued in response to a petition filed by two resident welfare organisations from Kurla and Chunabhatti areas in Mumbai. The petition highlighted the issue of noise pollution caused by several mosques and madarasas in the area and pointed out the indifference of city Police towards the matter. Despite repeated complaints to the local Police, no strict action has been taken, as claimed by the petitioners.

The Court stated on 23rd January that using loudspeakers for prayers or religious discourse is not an essential part of any religion. The Court ordered Mumbai Police to strictly enforce the ‘Noise Pollution (Regulation and Control) Rules, 2000’ and ensure that no religious place causes noise pollution.
The bench also noted that the relevant guidelines impose a fine worth Rs 5,000 per day on those causing noise pollution. If mosques cause noise pollution for 365 days, the total fine would be Rs 18,25,000.

‘We have a Hindutva Government in the State. Several devout Hindu organisations frequently raise complaints regarding the loudspeakers from the mosques. It is our duty to implement the Court’s verdict as it is. The law applies to everyone. Anyone who disrespects the Court’s order will face strict punishment from the Government’.

‘We welcome the ruling of the Bombay High Court. This is not the first time such a ruling has been given. The Court had issued similar orders earlier as well. The Government must follow the Court’s new guidelines. The Government should take a strong stand. Following this ruling, we will work according to the instructions given by Raj Thackeray’.
