Kolkata (Bengal) – “A crowd of 7,000 people came to vandalise the hospital. What were the Police doing ? The Police cannot save themselves. How will they save the doctors ?,” questioned the Calcutta High Court to the State Government and the Police in connection with the attack on R G Kar college and hospital on the night of August 14.

1. Lawyers appearing for the Bengal Government, while replying to the Court’s question, said that tear gas canisters were fired to control the violence. 15 Policemen were injured in this violence. The Deputy Commissioner of Police was also injured. The Police vehicles were also vandalised.

2. The High Court replied that Article 144 (prohibition of assembly) could have been applied. Had that been done, 7,000 people would not have been able to gather at the same time. This is a failure of the State Government. The goons were to go to the scene of crime (where a trainee female doctor was raped and murdered) on the third floor. They thought that the incident site was on the second floor. So they survived. The State administration has completely failed. The Police and the administration could not manage to protect the scene of crime in the hospital. In such a situation, we would close the hospital. We will transfer everyone. How many patients are there ?

3. On this, the lawyers of the Government said that the Police had nothing to do with the incident. The crime scene at the hospital is secure.

4. The Court agreed with the lawyers. The Court further stated, “Being a resident of the city, you should also be worried. I feel bad. You should be sad too. Could this vandalism have been stopped, that is the question. Who did this, is the latter part. The point is, what if the incident happened on August 14 repeats ? If the Police are injured and unable to control the mob, law and order will collapse. The most important thing is that doctors working in the hospital should be given adequate security to perform their duties.
