The PIL states,
- From a woman’s viewpoint, this is a retrograding and insulting system. Polygamy is against the Constitution, illegal and the Shariat. Polygamy has been allowed in Shariat in exceptional conditions.
- The issue concerning Muslim women needs to be controlled through law. In case a Muslim man wants to remarry then he has to get written permission from his previous wife and a written certificate sanction from a Govt officer. He should be able to take responsibility for all the wives. Before remarrying, the Muslim man should declare his previous marriages. A law should be passed to make the registration of marriages of Muslims compulsory.
