Karnataka High Court rebukes Police over illegal arrest !

Bengaluru (Karnataka) – Strongly criticising the illegal arrest of a man in a cheating case, the Karnataka High Court asked, “Do the Police think they can do anything regardless of the law? Is sending a person to prison a game?” The Court further observed, “If an offence has been committed, certainly send the accused to prison—but only in accordance with the procedure established by law.” It criticised the investigating officer for failing to comply with the legal safeguards governing arrests and directed the immediate release of the accused. The Court also ordered a departmental inquiry against the investigating officer attached to Bagalur Police Station.
“Why was the complainant’s husband arrested in such haste ?”
Questioning the necessity of the arrest, the Court asked, “Why was the complainant’s husband arrested in such haste in a cheating case? Should a husband be sent to prison the moment his wife lodges a complaint? Can a person be sent to prison merely because a cheating case has been registered?” The Bench further observed that the allegations concerned a partnership between husband and wife and asked, “If the alleged cheating relates to the partnership, why is only the husband in Police custody?”
New Station House Officer showed greater interest in the case !
The Court noted that the first investigating officer had carried out virtually no meaningful investigation for more than three months. Thereafter, a new officer took charge of the Police Station and showed greater interest in the case. He issued a notice directing the accused to appear and, alleging that he was not cooperating with the investigation, had him arrested more than four months after the FIR had been registered.
Referring to the Supreme Court’s binding guidelines on arrest, the High Court reiterated that arrest must be the last resort, particularly in offences punishable with imprisonment of up to seven years.
What is the case about ?
The FIR was registered on 19 December 2025. The allegations were that the husband had forged his wife’s signatures, prepared a partnership deed and opened a current account without her knowledge. Despite the registration of the case, no substantial investigation was carried out for more than three months, following which the accused was suddenly arrested.
