New York court’s major decision on Trump’s import tariff policy

New York (USA) – After the decision of the US Supreme Court, a federal court in New York has now also dealt a blow to the Trump administration. The court stated in its ruling that establishments which had paid the import tariffs imposed by the Trump government will now receive refunds of those amounts.

- Judge Richard Eaton of the US Court of International Trade stated that all importing establishments have the right to benefit from the decision of the US Supreme Court, in which several tariffs imposed by Trump were declared unconstitutional last month.
- In its ruling, the Supreme Court had declared the US tariffs illegal and stated that the tariffs imposed by Trump under the International Emergency Economic Powers Act of 1977 were unconstitutional.
- Judge Eaton stated in the ruling that he himself would hear the cases related to tariff refunds. This clarified how the process of refunding the tariffs to establishments would be carried out, as the Supreme Court had not mentioned this in its decision.
- Advocate Ryan Majerus stated that the government may appeal against the decision or seek time to halt the refund process.
- The US government had so far collected 130 billion US dollars (₹10 lakh 79 thousand crore) through these tariffs. According to experts, the government may have to refund up to 175 billion dollars (up to ₹14 lakh 52 thousand crore). This decision is particularly related to cases involving establishments in Atmus Filtration in Nashville, Tennessee, which had claimed tariff refunds.
