New Delhi – In the case concerning the obscene remarks made by Ranveer Allahbadia and Samay Raina on a program on their YouTube channel, the Supreme Court has directed the government to formulate regulations to control online dissemination of obscene content without infringing upon Article 19(1)(a) of the Constitution, which guarantees freedom of expression. Accordingly, the Union Ministry of Information and Broadcasting has made provisions for imprisonment and fines for such content under the ‘IT Rules 2026’.
A spokesperson for the Ministry of Information and Broadcasting stated that they are preparing the draft of these regulations as per the court’s directives, and it will be announced after it is finalized.
Which content will be considered as spreading obscenity ?
The Union government has based these proposed rules on the ‘Cable Television Network Rules 1994’ act, according to which any content that spreads lewdness, incites lust, and can consequently corrupt a person, will be considered obscene.
