
Prayagraj (Uttar Pradesh) – The State Government can stop grants to unauthorised madarasas in Uttar Pradesh; but has no legal right to stop their functioning, opined Allahabad High Court in the case of ‘Madarasa Ahl-e- Sunnat Imam Ahmad Raza’ located in Shravasti district, challenging the order passed by the district minority welfare officer to stop its activities since it was not recognised by the Government. The Court has passed the above verdict in this case.

The Court has mentioned in its verdict that in the 2016 regulation, there is a provision only to stop grants but no provision to close down a madarasa if it is unauthorised. The Government, therefore, has no right to stop the educational activities of such organisations.
