Supreme Court stays the punishment order against Manikrao Kokate

Mumbai – The Supreme Court has stayed the order of imprisonment given to NCP leader Manikrao Kokate, in the matter of obtaining flat using false documents under the Chief Ministers quota. On 22 December the matter was heard by the bench of Chief Justice Suryakant and Justice Joymalya Bagchi. The District Court had given the sentence of penalty and imprisonment of 2 years. Kokate appealed this in the Bombay High Court.

The Bombay High Court had temporarily stayed Kokate’s sentence without quashing it. Kokate had gone in appeal to the Supreme Court to annul the punishment. The Supreme Court has stayed the punishment. Because of this Kokate’s status as an MLA remains unchanged. Although the Supreme Court has stayed the sentence, it has observed that he will not be able to hold any important post.

Justice Joymalya Bagchi noted that there were several flaws in the process of convicting Manikrao Kokate.
