Supreme Court upholds Madhya Pradesh High Court’s decision; denies bail to accused Wasid Khan

Case involving a conspiracy to establish India into an Islamic State based on Sharia law

New Delhi – The Supreme Court has upheld the decision of the Madhya Pradesh High Court and refused to grant bail to the accused Wasid Khan. Khan has been accused of being part of a conspiracy aimed at disrupting communal harmony and re-establishing the pre-British ‘Mughal Order’.

A bench comprising Justices M M Sundresh and Vipul M Pancholi heard the matter. Senior advocate Shabb Alam represented Khan, arguing that since the ban on the Popular Front of India (PFI) in 2022, Khan has had no association with the organisation. However, the court observed that there was evidence supporting the charges against him.

Opposing the bail plea, senior advocate Nachiketa Joshi, appearing for the National Investigation Agency (NIA), stated that documents titled ‘Vision 2047’ were recovered from Khan, which outlined plans to turn India into an Islamic nation governed by Sharia law.

Justice Sundresh noted that the case involves attempts to incite religious tensions and wage war against the State. Hence, the court was not inclined to intervene at this stage. The bench suggested that the petitioner withdraw the plea and reapply before the lower court after some time. Consequently, the special leave petition was withdrawn.
