Affidavit of the Union Government on the instructions of the Supreme Court

New Delhi: The Union Government has refused to accept the Supreme Court’s suggestion that death row convicts should be given the option of lethal injection instead of hanging. A PIL had stated that, a lethal injection should be administered instead of traditional execution or the right should be given to choose between the two. Lethal injection is swift, humane, and dignified. Execution is a cruel, inhuman and lengthy process. It also said that the option of injecting is already available in the Army.
The government said in its affidavit that it was practically not possible to provide an alternative to injections. Offering such an option is a policy decision.

The petitioner argued that the present execution process causes the convict to face prolonged pain and suffering. Instead, methods such as lethal injection, firing squads, electric shocks, or gas chambers may be used, which can kill a person within minutes. It can take up to 40 minutes to die by hanging. Lethal injections are used in 49 of the 50 states of the United States.
