Mumbai – A hearing was held in the Mumbai High Court on the bail plea of Delhi University professor Hany Babu, who is accused of inciting the Bhima Koregaon riots. The bench of judges stated that the decision would not be made on the merits of the case but rather based on the fact that Babu has been in prison for a prolonged period without trial, and accordingly, the decision has been reserved.
Babu is accused of delivering an inflammatory speech at the Elgar Parishad event, which allegedly incited the Bhima Koregaon violence. The National Investigation Agency (NIA) arrested him in 2020.
Arguments Made by Babu’s Lawyer
Babu has been in prison for the past 5 years and 2 months. Charges have not yet been formally framed against him. Keeping someone in jail without trial is a violation of their fundamental rights, as stated by the Supreme Court, argued Babu’s lawyer.
Government’s Argument Against Bail
There is sufficient evidence against Babu. In serious offenses, bail cannot be granted solely on the basis of long incarceration, argued Additional Solicitor General Anil Singh on behalf of the Union Government, opposing Babu’s bail plea.
