Supreme Court rebukes Patna High Court for granting anticipatory bail in murder case

New Delhi – The Supreme Court set aside the anticipatory bail granted by the Patna High Court to two accused in the daylight murder of a woman, strongly criticising the High Court’s approach.

The bench observed, “While the protection of individual liberty is important, courts must not turn a blind eye to the suffering of the victims. Courts must balance both.”

The Court further said that the High Court “failed to record any reason for directly granting anticipatory bail without impleading the complainant as a party. This discretion was totally uncalled for especially at the stage of anticipatory bail.”

The Supreme Court ordered the accused to surrender before the police within four weeks. Thereafter, they may apply for regular bail as per procedure.
