The use of verbal ‘talaq’ is harmful to societal well-being !

New Delhi – The use of verbal ‘talaq’ within the Muslim community poses a serious threat to societal welfare and results in severe distress for Muslim women. Those affected by this practice frequently have no alternative but to turn to the police for help. Because there were no penal provisions in the law, the police could not intervene against the husband. To remedy this situation, the Union Government presented an affidavit to the Supreme Court, proposing a law to outlaw verbal talaq. The government submitted this affidavit to the court in response to a petition challenging the Act.
The government further asserted that a legal framework is necessary to stop Muslim husbands from enforcing instant divorces, in order to mitigate the issue of verbal talaq. It is not the court’s role to decide the specifics of this law. The government highlighted that its primary duty is to determine what is best for the country’s people.
