Why action only against boys, when minor boys and girls date ? : Uttarakhand HC questions State Government

Nainital (Uttarakhand) – The Uttarakhand High Court has questioned Uttarakhand State Government why only minor boys are arrested when minor girls and boys date without their parents’ consent. In such cases, the Police take action only against the boys, hence the Court has asked this question. The question was raised during the hearing of a PIL filed by Advocate Manish Bhandari in the High Court.

Do not arrest the minor boys; reprimand and release them

The High Court asked if recording a statement under Section 161 of the IPC be sufficient to avoid arresting the boy involved. The Court asked if arresting the boy is essential. The boy can be called and reprimanded and asked not to engage in such things in the future, but he should not be arrested. The Court directed that the State Government should consider and direct the Police accordingly.

The Public Interest Litigation (PIL) was filed by Advocate Manish Bhandari. In the PIL, he highlighted the gender disparity when it comes to such cases, claiming that while girls are often viewed as victims even in consensual relationships, teenage boys are seen as perpetrators. Bhandari claimed to have met 20 such boys in the Haldwani jail during a recent visit.
