New Delhi – BJP MP Harnath Singh Yadav demanded to repeal the Places of Worship Act 1991 in the Rajya Sabha on 5 th February.

MP Harnath Singh Yadav highlighted the following points:
1. This Act violates the principles of equality and secularism enshrined in the Constitution, which are an integral part of the Preamble and basic Constitutional structure.
2. The act prohibits judicial review, which is a fundamental feature of the Constitution. This act curtails the religious rights of Buddhists, Jains, Sikhs and Hindus and discriminates between Deity Shriram and Deity Shrikrushna.
3. After independence, those in power for a long time did not realise the importance of places of worship. These people developed a tendency to be ashamed of their own culture for their political gain.
4. The previous Government legally supported the taking over of religious sites including Gyanavapi and Shrikrushna Janmabhoomi by foreign invaders at the point of sword. There cannot be two laws for similar actions and circumstances. This law is completely against the principles of federalism. In such situations, for the benefit of the country, this law should be enacted.

What is ‘Places of Worship Act 1991’ ?
The ‘Places of Worship Act 1991’clearly states that ‘religious places shall remain as they were before independence i.e. on 15th August 1947 and shall not be tampered with in any way’; But the case of Shriram Janmabhoomi was considered as an exception.
