Action on illegal constructions on roads, footpaths, and railway tracks excluded

New Delhi – The Supreme Court has issued an interim order halting bulldozer action on illegal constructions until 1st October 2024. The Court stated, “No action should be taken using bulldozers without the Court’s permission.” The Court, however, clarified that the order does not include actions against illegal constructions on roads, footpaths, and railway tracks. The next hearing in the case is scheduled for 1st October 2024.
1. Solicitor General Tushar Mehta, representing the Union Government, argued before the Court that the Constitutional institutions cannot be restrained like this through such orders.
2. In response, the Court remarked that heaven is not going to fall by halting the work for two weeks and silenced him by stating that it is not going to make much difference in fifteen days.
3. In recent months, the States like Uttar Pradesh and Madhya Pradesh have used bulldozers to demolish illegal constructions of offenders, against which, a petition has been filed in the Supreme Court.
