1. There is an Idgah Mosque on the land of Shrikrushna Janmabhoomi. The Mosque stands on the site of the original Krushna Janmabhoomi, which is Kans’ prison where Shrikrushna was born. Aurangzeb demolished the original Shrikrushna Temple and built the Shahi Idgah Mosque in its place. The appeal asks that this, 13.37 acres of land be handed back to the Hindus. This petition had been dismissed earlier, thereafter an appeal was filed again on which the Court has ordered that a survey be conducted of the mosque. This appeal also says that the 1968 agreement between Shrikrushna Janmasthan Seva Sangh and Shahi Idgah Mosque about this land is illegal.

2. In the earlier petition the prayer was that the Mosque that stands on the site should be removed and Shrikrushna devotees be allowed to worship there. The Court had at that time dismissed the petition saying that under the 1991 Places of worship act the status of the place as on 15th August 1947 was to be maintained. The Court had also added that if this petition was allowed then numerous devotees will make numerous petitions in the Courts.
