According to Islamic law, Muslim men have the right to polygamy

Chennai – ‘According to Islamic law, Muslim men have the right to polygamy; however, a Muslim man is obliged to treat his wives equally. If he does not, it would be cruel. The husband must take proper care of his wife’, the Madras High Court ruled.

The verdict of the lower Court is valid 

In one case, the High Court upheld the lower Court’s decision to allow the divorce petition filed by the aggrieved wife. The High Court noted that the husband and his family harassed the former’s first wife. She was also mistreated during pregnancy. Tired of this, the wife had left her husband’s house. Later her husband remarried another woman and was living with her.

Wife can seek divorce on the grounds of cruelty 

In another case, the Allahabad High Court held that in cases of cruelty, a Court should consider other circumstances before ordering the restoration of marital relations. A wife can seek divorce on the grounds of cruelty.
