The accused stay in jail for years due to prolonged judicial cases : Justice Bharati Dangre

Mumbai – Justice Bharati Dangre of the Bombay High Court has expressed her opinion on the prolonged judicial cases. She said, ‘The accused have to stay in jail for years due to prolonged judicial cases. In the absence of speedy trials, the accused stay in jail for a very long time. In such cases, the accountability of the Courts should be fixed’.

Shishir Kumar, an accused in a murder case, had appealed to the High Court for bail. He was arrested on 18th January 2016. The High Court had ordered a regular hearing on 30th September 2022 in order to end his case on time; but even after a year, nothing has been concluded. When the defence lawyer pointed out this fact, Justice Bharati Dangre approved Shishir Kumar’s bail application. While approving the bail application, she expressed the above opinion. Justice Dangre added, ‘In this case, the public prosecutors have not displayed seriousness. They did not take care to present the witnesses on the dates given by the Court. The Court has also failed to establish accountability for the presence of the accused’. (Why does a judge have to tell this ? Why is the accountability not fixed at the Court’s level ? – Editor)
