This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>.<\/u><\/span><\/span><\/span><\/span><\/p>\n

The words WE and US, used in this user agreement means Santkrupa Pratisthan the firm who owns this site <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>. “SantKrupa Pratisthan” is a NGO who has initiated this noble project to propagate its and like minded organisations periodicals. The word \u201cYOU\u201d \u201cYOUR\u201d referred in this agreement means the person who is using the website, <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>for making online purchases.<\/span><\/span><\/span><\/p>\n

User Agreement<\/b><\/span><\/span><\/span><\/strong><\/p>\n

For the purposes of this User Agreement, \u2018User\u2019 or \u2018buyer\u2019 and wherever the context may require \u2018You\u2019 (or any variation thereof), shall mean any natural or legal person who has agreed to become a user of the Website by accessing or browsing the Website and\/or has registered as a member of the Website by submitting identification information\/ registration details using the

Restrictions on your expressions <\/span><\/span><\/span><\/strong>You agree and undertake not to host, display, upload, modify, publish, transmit, update or share any information or list any information or item that:<\/span><\/span><\/span><\/p>\n

a. belongs to another person and to which You do not have any right to;<\/span><\/span><\/span><\/p>\n

b. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilia, libellous, invasive of another\u2019s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to \u201cindecent representation of women\u201d within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;<\/span><\/span><\/span><\/p>\n

c. harm minors in any way;<\/span><\/span><\/span><\/p>\n

d. infringes any patent, trademark, copyright or other proprietary rights or third party\u2019s trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen items;<\/span><\/span><\/span><\/p>\n

e. violates any law for the time being in force; <\/span><\/span><\/span><\/p>\n

f. deceives or misleads the addressee\/ users about the origin of such messages or communicates any information which is grossly offensive or menacing
\nin nature;<\/span><\/span><\/span><\/p>\n

g. impersonate another person or use an anonymous proxy;<\/span><\/span><\/span><\/p>\n

h.contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;<\/span><\/span><\/span><\/p>\n

i.threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;<\/span><\/span><\/span><\/p>\n

j. shall not be false, inaccurate or misleading;<\/span><\/span><\/span><\/p>\n

k. shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force; <\/span><\/span><\/span><\/p>\n

l. may give rise to liability on part of the Website or the <\/span><\/span><\/span>sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>or cause any hindrance (in whole or in part) with respect to the services of ISPs or other suppliers of the Website or the <\/span><\/span><\/span>sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>; and <\/span><\/span><\/span><\/p>\n

m. link directly or indirectly to or include descriptions of items that are <\/span><\/span><\/span><\/p>\n

(i) prohibited under the User Agreement or any other applicable law for the time being in force including but not limited to the Drugs and Cosmetics Act, 1940, the Drugs And Magic Remedies (Objectionable Advertisements) Act, 1954, the Indian Penal Code, 1860, Information Technology Act 2000 as amended time to time and rules there under or<\/span><\/span><\/span><\/p>\n

(ii) are at the same time listed for sale on a web site other than the Website. You shall not promote any website or webpage or link on the Website.<\/span><\/span><\/span><\/p>\n

In case of any violation of the above provisions, <\/span><\/span><\/span>sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>has the right to immediately terminate the access or usage rights of the user to the Website without any notice and any such violative information that is displayed or submitted on the Website can be removed immediately and completely.<\/span><\/span><\/span><\/p>\n

1.Membership Eligibility<\/b><\/span><\/span><\/span><\/strong><\/p>\n

Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are \u201cincompetent to contract\u201d within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website or pay subscription. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the Website and shall not, purchase any items on the Website. 2.Your Account and Registration Obligations<\/b><\/span><\/span><\/span><\/strong><\/p>\n

If you use the Website as Registered User, you are responsible for maintaining the confidentiality of your User ID and Password. You agree, inter alia, to: 1.Provide true, accurate, current and complete information about yourself as provided by <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>registration form 2. You must not include any of your contact details such as email addresses etc in your User ID while registering as Registered User; and 3.Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the User Agreement, <\/span><\/span><\/span>www.sanatanprabhat.org <\/span><\/span><\/span><\/span><\/a>has the right to indefinitely suspend or terminate or block access of your membership with the Website and refuse to provide you with access to the Website.<\/span><\/span><\/span><\/p>\n

3. Electronic Communications<\/b><\/span><\/span><\/span><\/strong><\/p>\n

When You use the Website or send emails or other data, information or communication to www.sanatanprabhat.org, You agree and understand that You are communicating with<\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>, through electronic records and You consent to receive communications via electronic records from <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>, periodically and as and when required. <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>, will communicate with You by email or by text message or by an AB Post notice or electronic records on the <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>, Website which will be deemed adequate service of notice \/ electronic record.<\/span><\/span><\/span><\/p>\n

4. Order and delivery of products<\/b><\/span><\/span><\/span><\/strong><\/p>\n

a. You agree that as soon as you place the order through the specified channel from the website, you will not be entitled to cancel, alter or modify the said order in any way <\/span><\/span><\/span>sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>reserves all rights for such cancellations, alterations or modifications or rejecting to accept the order without specifying any

The contents therein are either originating from the science of spirituality as observed\/researched by the editors or personal experiences of some individuals or some news articles, editorials and such other newspaper contents which have been published with a bonafide intention to educate the subscriber and not to insult the religious emotions of any person and not for crating rift between any section of people. You accept that the implementation of any of the portion from the newspaper is strictly at your own risk and advantage. Neither us nor the editors of the newspaper or printing press of the Sanatan Prabhat will be held responsible for fraudulently inducing you to implement it. You accept and understand that the contents of our product are intended for education and public awareness towards Dharma and do not intend to harm\/insult the religious emotions of any person not for creating rift, enmity or hatred between or against any section of society. <\/span><\/span><\/span><\/p>\n

b. You accept that the distribution network initiated through this website is not for to earn profit and is for the benefit of humanity. All possible care has been taken to deliver you the products. Our responsibility with reference to the delivery to the subscriber that is to you will be restricted to the delivery of the product to the post office and the delivery will be governed by the post office (http:\/\/www.indiapost.gov.in\/) <\/span><\/span><\/span><\/p>\n

c. However you accept that there will be no claim of any additional compensation on your part in this respect.<\/span><\/span><\/span><\/p>\n

d. You accept that at present the delivery will be done by the Indian Post Department by ordinary post. The Delivery on the part of the website is complete when it is delivered with the Indian Post Department. You accept that any loss caused to you because of delay in delivery, damaged package or theft or such other damage in transportation will not be our responsibility.<\/span><\/span><\/span><\/p>\n

In particular, <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>, may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. Changes to the Credit policies shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website.<\/span><\/span><\/span><\/p>\n

5. You agree, undertake and confirm that your use of the Website shall be strictly governed by the following binding principles<\/b><\/span><\/span><\/span><\/strong><\/p>\n

6. Legal Compliances<\/b><\/span><\/span><\/span><\/strong><\/p>\n

You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules there under as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax\/ VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding your use of our service for purchase of products.<\/span><\/span><\/span><\/p>\n

7. Privacy<\/b><\/span><\/span><\/span><\/strong><\/p>\n

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We view protection of users\u2019 privacy as a very important community principle. We understand clearly that you and Your Personal Information is one of our most important assets. Instamojo Facility also enables automated collection and remittance services. using the current Indian banking and credit\/ debit\/ cash card\/ paymate\/ oxicash\/ zipcash and such other infrastructure directly through Bank or financial institution infrastructure or indirectly through Payment Aggregator or through any facility as may be authorized by the Reserve Bank of India for collection, refund and remittance, as the case may be of payment or supporting the same in any manner. Instamojo Facility could be availed under Instamojo User Agreement, Instamojo Seller Terms and Conditions and other Instamojo Rules and Policies. You would be asked by <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>to separately accept the aforesaid Instamojo User Agreement, Instamojo Seller Terms and Conditions and other Instamojo rules and policies as may be required and applicable for your nature of activities.<\/span><\/span><\/span><\/p>\n

9. Breach<\/b><\/span><\/span><\/span><\/strong><\/p>\n

1. If you breach the User Agreement or the documents it incorporates by reference, <\/span><\/span><\/span>www.sanatanprabhat.org <\/span><\/span><\/span><\/span><\/a>reserves the right to recover any amounts due and owing by you to <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.<\/span><\/span><\/span><\/p>\n

10. Area of operation: <\/b><\/span><\/span><\/span><\/strong>India only<\/b><\/span><\/span><\/span><\/p>\n

11. Buying<\/b><\/span><\/span><\/span><\/strong><\/p>\n

All purchases (under the Buy It Now format) on the Website are a firm commitment to purchase. If you are the purchaser for any item and your purchase is accepted by the seller you are obligated to complete the transaction with the seller, <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>.<\/u><\/span><\/span><\/span><\/span><\/p>\n

None of the provisions of the User Agreement shall be deemed to constitute a partnership or agency between you and www.sanatanprabhat.organd you shall have no authority to bind<\/span><\/span><\/span>www.sanatanprabhat.org <\/span><\/span><\/span><\/span><\/a>in any manner whatsoever. Except as explicitly stated otherwise, any notices shall be given by postal mail on behalf of <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>to \u2018Sanatan Prabhat\u2019, C\/o \u2018Sanatan Ashram\u2019, Sanatan Sankul, Post ONGC, Devad, Tal. Panvel, Dist. Raigad 410 221 Maharashtra.(India) or to the email address you provide to us during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to us during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.<\/span><\/span><\/span><\/p>\n

If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the User Agreement. This Agreement sets forth the entire understanding and agreement between You and www.sanatanprabhat.org with respect to the subject matter hereof.<\/span><\/span><\/span><\/p>\n

In www.sanatanprabhat.org sole discretion, <\/span><\/span><\/span>www.sanatanprabhat.org <\/span><\/span><\/span><\/span><\/a>may transfer its rights and obligations (also known as \u201cassign\u201d) under this Agreement without your prior express consent, provided that <\/span><\/span><\/span>www.sanatanprabhat.org <\/span><\/span><\/span><\/span><\/a>assigns the Agreement on the same terms or terms that are no less advantageous to You.<\/span><\/span><\/span><\/p>\n

13A. Grievance Officer<\/b><\/span><\/span><\/span><\/strong><\/p>\n

In accordance with Information Technology Act 2000 and rules made there under, the name and contact details of the Grievance Officer is published on the Website.<\/span><\/span><\/span><\/p>\n


\n<\/span><\/span><\/span>14. Arbitration and Place of Jursidiction<\/b><\/span><\/span><\/span><\/strong><\/p>\n

If any dispute arises between you and <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a> <\/u>during your use of the Website or Instamojo or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement, Instamojo User Agreement and Instamojo Terms and Conditions or the documents they incorporates by reference, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by <\/span><\/span><\/span>www.sanatanprabhat.org<\/span><\/span><\/span><\/span><\/a>. The place of arbitration shall be Panvel (Maharashtra). The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.
